  • DiMarzio is sueing Sheptone over double-creme

Look like somebody has the stones to go to court over the infamous trademark.

Your can make a donation to help Sheptone to pay the estimated 100K of legal fees in the gofundme.com site.

This needs to be reversed and hopefully is will spread through those social media sites. I am not a member of those sites but donated to help the cause.

I believe this is an extension of the "logic" which lead Owens Corning and Sweet and Low to try to trademark the color pink:
        http://scholarship.law.duke.edu/cgi/...61&context=lcp
Law is the effort to codify an endless stream of arbitrary and irrational decisions, as if science were never invented.

Guys, this is exactly the reason why I posted my recent color trademarks thread a month ago, to get the ball and conversation rolling on this matter. I was the first to be informed of the lawsuit, but held off stating who it was until he was ready to come forward.
Go see the other thread for more details, and see the mountain of evidence I have that supports invalidation at Index of /trademark

a MOUNTAIN of evidence that suggests the mark can be overturned an should never have been granted in the first place.
Researching this has been a full-time hobby of mine for 18 years.

Are they crazy ? The Chinese are flooding the market with double cream pickups - for example, these: Sell Free Shipping a set of Alnico 2 or Alnico 5 guitar humbucker pickups in Cream color-in Guitar Parts & Accessories from Sports & Entertainment on Aliexpress.com | Alibaba Group
Very nice pickups once the cable, slugs and pole screws are changed ;-)

I'm picturing the idea of DiMarzio suing "China" for trademark infringement... Um, well, DM could probably settle for a few million if he just sold out...

Personally, I think that if DM abandoned their own trademark, then it should be fair game. If that is your exclusive selling point, then DM should have stuck with it. Also, the way they go after the small guys... If I understand correctly, the whole double-creme thing was for the Super Distortion? So if it doesn't have 12 oversize hex-screw poles, then it's fair game & not covered by the "mark." I don't think Duncan, Fralin, Sheptone, Lawrence, or any of yous guys using 6 screws & 6 slugs is any more in violation than Carvin using 24 hex screws. He'll, I think the Carvin is the WORST offender in this case!

Otherwise, I wonder if "parody" pickups would be exempt... :P I'm sure I could come up with something - introducing the new Barry MiDarzio Stupid Extortion?

Guys... the trademark is valid only for American Companies selling on American soil.

I know, but still... it'd be kinda funny to sue a whole country. I can think of a select few who are crazy enough to try it.

11 pole pieces in the Carvins, 22 for the hb's. I know it's easy to lose count when there's so many. AND I consider Carvins to be parody pickups anyway, but I DO like your suggestion.
This isn't the future I signed up for.

The hex screws were specifically disclaimed as being a feature of the trademark, thru the use of dotted lines in the drawing.

HAHA! "Stupid Extortion" that's funny as hell.
